CB: I think you have the UN definition wrong. Viet Nam does fit it
because of the "destroy ...in part" language; and it would be... uh
racist  to claim there was no racist motive in the US war. The "in part"
language means they didn't have to intend to remove the Vietnamese from
the face of the earth.   See below


Article II: In the present Convention, genocide means any of the
following acts committed with intent to destroy, in whole or in part, a
national, ethnical, racial or religious group, as such:
